TEMPORARY GRAZING LEASE AND RELEASE OF LIABILITY

Fee: $200 (two hundred dollars)

PartiesThis Agreement (“Agreement”) is made between The Property on Ice LLC (“Lessor”), and Travis Schwerbel (“Lessee”). Stu Hicks and BendLand are additional parties expressly named as Released Parties for purposes of liability protection.

1. Purpose and Premises

Lessor grants Lessee a temporary, non-exclusive license to graze livestock on the parcel located at 2968 NW Ice Avenue, Redmond, Oregon (“Premises”). This Agreement does not include access to, or use of, any dwellings, structures, or improvements on the Premises.

2. Consideration

Lessee shall pay Lessor a one-time, non-refundable fee of $200, due upon signing this Agreement.

3. Release and Hold Harmless

Lessee, on behalf of himself and all agents, guests, invitees, family members, and any owners of livestock grazing on the Premises, hereby:

• Releases, waives, and discharges Lessor, BendLand, Stu Hicks, their members, managers, employees, and assigns (collectively, the “Released Parties”) from any and all claims, demands, causes of action, losses, or liabilities, whether known or unknown, arising out of or related to use of the Premises.

• Assumes all risks associated with grazing, handling, or pasturing livestock, including injury, escape, death, property damage, or harm to any person or animal.

• Agrees to indemnify and hold harmless the Released Parties from any and all damages, injuries, deaths, claims, or expenses (including attorney fees) arising from Lessee’s activities or those of his livestock, guests, or agents.

4. Condition and Care of Premises

Lessee accepts the Premises “as is” and shall maintain reasonable care to prevent damage.  Lessee may make improvements to fences, and alterations, as may be necessary at Lessee's expense.

5. Compliance with Law

Lessee shall comply with all applicable Oregon Revised Statutes, including but not limited to ORS § 105.682–§ 105.696 (Recreational Use and Liability), ORS § 30.687–§ 30.697 (Livestock Activities), and any Deschutes County livestock or fencing regulations.

6. Termination

This Agreement automatically renews on November 1, 2025, unless ended earlier by mutual written consent. Lessee shall remove all livestock and property upon termination.

7. Entire Agreement

This Agreement constitutes the entire understanding between the Parties and supersedes all prior discussions. No modification is valid unless in writing and signed by both Parties.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Oregon.
